These Terms of Service ("Terms") govern your access to and use of the RentComp API service, website, and related services (collectively, the "Service") provided by RentComp ("we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.
By creating an account, accessing the API, or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
RentComp API provides rental comparable data, estimated rent ranges, market trends, and HUD Fair Market Rent information for residential properties in the United States. The Service is delivered via a RESTful API and is intended for use by software developers, property managers, lenders, appraisers, and other property professionals.

Your API usage is subject to rate limits based on your subscription plan. Rate limits are enforced per API key and include:
Exceeding your rate limits will result in HTTP 429 responses. Persistent abuse of rate limits may result in temporary or permanent suspension of your API access.
You agree to use the API in a manner consistent with its intended purpose. Automated scraping, bulk downloading for the purpose of building a competing dataset, or systematic retrieval of data beyond your plan's quotas is prohibited.

The Service, including its algorithms, data models, aggregation methods, documentation, website design, and branding, is owned by RentComp and protected by intellectual property laws. These Terms do not grant you any ownership rights in the Service.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the API and the data returned by it for your internal business purposes or within your applications. You may display or incorporate API data in your products, provided you do not misrepresent the data source or claim it as your own proprietary data.
You retain ownership of any data or content you submit to the API (such as property addresses and parameters). By submitting data to the Service, you grant us a limited license to process that data solely for the purpose of providing the Service.

All fees are non-refundable except as required by applicable law. We reserve the right to change pricing with 30 days' notice. Price changes do not apply retroactively to existing billing periods.

API responses are estimates based on available data and should not be treated as certified appraisals, guaranteed rental values, or official government data. Users are responsible for independently verifying data before making business decisions.
To the maximum extent permitted by law, RentComp and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
You agree to indemnify, defend, and hold harmless RentComp from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
You may terminate your account at any time by canceling your subscription and ceasing use of the API. Termination does not entitle you to a refund of prepaid fees for the current billing period.
We may suspend or terminate your access to the Service immediately, without prior notice, if:
Upon termination, your API key will be revoked and your access to the Service will cease. Sections relating to intellectual property, limitation of liability, indemnification, and governing law survive termination.
We strive to maintain high availability but do not guarantee uninterrupted service. We may perform scheduled maintenance, deploy updates, or experience downtime due to circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned maintenance.
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the effective date. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms. If you do not agree with any changes, you must stop using the Service.
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from or related to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.
